What is eminent domain?

Eminent domain refers to the power the government has to take private property if it is deemed necessary for use by the public. A private developer can also take property on behalf of the government.

What institutions have the power of eminent domain?

Any local, state, and federal government maintains the power of eminent domain. In certain cases, agencies that provide public services, like utility companies, can be granted this power as well.

Does the government always provide a fair offer for land?2024

While you may assume the government will provide a fair offer for your land, like anyone interested in buying property, officials will try to obtain the property for the lowest price possible. The government does have to offer compensation that aligns with the fair market value of your land, but the appraisal will usually be done by an expert hired by the government.
